Terms & Conditions
1. DEFINITIONS
In this document, the following terms have the following meanings: 1.1 - 'Buyer' means the person buying the product 1.2 - 'Consumer' shall have protection via s.12 of the Unfair Contract Terms Act 1977 1.3 - 'Goods' means the product sold from the seller 1.4 - 'List Price' means the price maintained by the seller as amended from time to time 1.5 - 'Seller' means Way Forward (Shop) Ltd 1.6 - 'Terms and Conditions' means the conditions of sale set out in this document and any special conditions at the discretion of the seller 2. GENERAL 2.1 - These terms and conditions are for contracts for the sale of goods by the seller to the buyer and any additional documentation or communication from the buyer. 2.2 - All orders for goods are deemed to be an offer to contract by the buyer and to complete the contract of sale, the seller must accept this offer. The seller reserves the right to refuse an offer of contract. 2.3 - Acceptance of delivery constitutes conclusive evidence of the buyer's acceptance of these terms and conditions 2.4 - Any variation to these terms and conditions are inapplicable unless agreed in writing by the seller 2.5 - Nothing in these terms and conditions affects the buyer's statutory rights as a consumer 3. PRICE AND PAYMENT 3.1 - The price of the goods as displayed on the seller's website ‘thejohnnyshop.co.uk’ is applicable at the date of order. 3.2 - Payment of the total charge for goods must be made in full before delivery. 4. DELIVERY 4.1 - Delivery of the goods or notifying the buyer that the goods are ready for collection or delivery to such place and on such terms as agreed between the parties at the time the order is placed 4.2 - All goods, wherever dispatched to should be delivered within five working days of the order being placed wherever possible. This is subject to 100% of the price being paid at the date of order and the buyer being present at the time of delivery 4.3 - The seller shall use it's discretion with regards to any date stated for delivery. In any event, time of delivery being delayed, the seller shall not be liable for any losses or costs incurred by the buyer or a third party arising directly or indirectly out of the delay to the agreed delivery date 4.4 - Some goods may not be available when the order is placed. In the event that the seller is unable to deliver the goods as specified in Clause 4.2, the seller will contact the buyer offer alternatives and the buyer will be entitled to cancel the order and receive a full refund of monies paid 5. WARRANTY 5.1 - The seller warrants the goods subject to delivery correspond to the description given by the website 6. CANCELLATIONS AND RETURNS 6.1 - The buyer shall inspect the goods following receipt and shall notify the seller within seven days that they do not comply with any part of the contract. 6.2 - Where a claim of defective goods must be the responsibility of the seller to collect faulty goods, the seller asks that the goods shall be returned by the buyer to the seller in return for replacement goods or a full refund, including return delivery charges if the goods prove to be defective. Where returned goods prove to be the buyer's fault the buyer will be liable for the cost of return delivery charges 7. LIMITATION OF LIABILITY 7.1 - Nothing in these terms and conditions seeks to limit the liability of the seller for death or personal injury as well as any direct loss or damage suffered by the buyer as a result of any negligence, breach of contract or otherwise caused by the goods 7.2 - The seller shall not be liable to the buyer or any third party for any indirect or consequential or other economic loss suffered by the buyer howsoever, with the exception of negligence, breach of contract or misrepresentation 8. FORCE MAJEURE 8.1 - Neither party shall be required to perform any of it's obligations if the delay or failure to complete an order is outside of its reasonable control, including but not limited to any of the following: floods, accidents, war, fire, breakdown of plant or machinery or the stoppage of materials from a natural source of supply, industrial strike action, and the seller's completion of the order is an extension of its obligations 9. GOVERNING LAW AND JURISDICTION 9.1 - These terms and conditions are construed in accordance with English law and the exclusive jurisdiction of the English courts ![]() |
